Terms & Conditions

These Terms and Conditions ("Terms") apply to your use of the website devinepainting.co.za (the "Site") and to any residential painting services provided by Devine Painting ("we", "us", "our"). By using the Site or engaging us for work, you agree to these Terms.

1. About us

Devine Painting is a residential painting business based in Johannesburg, Gauteng, South Africa. Contact: bianca@devineprojects.co.za · 082 059 0933.

2. Use of the Site

The Site is provided for general information about our services. You agree to use it only for lawful purposes and not to attempt to interfere with, damage, reverse-engineer or gain unauthorised access to the Site or any related systems.

We may update, change or remove content on the Site, or temporarily suspend access to it, at any time and without notice.

3. Quotes and estimates

  • Quotes are based on the information you share with us and on what is reasonably visible during our on-site assessment.
  • Unless expressly stated otherwise, quotes are valid for 30 days from the date of issue.
  • A quote is an offer to perform the described work; a contract is formed only once you accept the quote in writing (including by email or WhatsApp) and, where applicable, pay any required deposit.
  • If site conditions differ materially from what was assumed (for example hidden damp, cracked plaster, previously incompatible coatings, structural repairs or additional surface preparation), we will inform you and provide a variation quote before proceeding with the additional work.

4. Scope of work

The scope of work is limited to what is specifically described in the accepted quote. Anything not listed — for example moving heavy furniture, electrical or plumbing work, structural repairs, roof waterproofing beyond the quoted area, tiling, carpentry, or lifting of built-in fixtures — is not included unless separately agreed in writing.

5. Client responsibilities

Before and during the work, you agree to:

  • Provide safe and reasonable access to the property during agreed working hours
  • Provide access to water and electricity at no cost to us
  • Remove or secure valuables, fragile items, artwork and sensitive electronics from the work areas
  • Confirm colour choices, sheens and finishes in writing before we begin
  • Disclose any known issues such as damp, asbestos, lead-based paint, unstable substrates or previous coatings that may affect the work
  • Keep children and pets away from active work areas for their safety

6. Payment

  • Payment terms, including any deposit and progress payments, will be set out in your accepted quote.
  • Unless otherwise agreed in writing, the final balance is due on practical completion of the work.
  • Overdue amounts may attract interest at the maximum rate permitted by South African law.
  • Ownership of any materials supplied by us passes to you only once your account has been paid in full.

7. Colour, finish and materials

Colour appearance can vary depending on lighting, substrate, sheen level, sample size and screen calibration. We recommend approving colours from a physical sample or test patch on the actual surface. We are not responsible for a client's dissatisfaction with a colour that has been approved and correctly applied.

Where you supply your own paint or materials, we cannot warrant the finish, coverage or durability of those products.

8. Workmanship warranty

We take pride in our workmanship. Unless otherwise agreed in writing, we warrant our labour against defects arising from faulty workmanship for the period stated in your quote. This warranty does not cover:

  • Normal wear and tear, fading, chalking or weathering
  • Damage caused by damp, leaks, structural movement, subsidence, roof or gutter failure, plumbing or waterproofing issues that are not part of the quoted scope
  • Damage from cleaning, knocks, scuffs, pressure washing, harsh chemicals or third parties working on the property after us
  • Existing coatings that fail due to poor adhesion of the underlying paint layers not applied by us
  • Substrates that were previously painted with incompatible or unknown coatings
  • Client-supplied materials or client-specified deviations from our recommendations
  • Acts of God, extreme weather, fire, flood, vandalism or force majeure

To claim under this warranty, notify us in writing within a reasonable time of discovering the defect and give us reasonable access to inspect and remedy it.

9. Insurance and liability

We take reasonable care to protect your property. To the maximum extent permitted by law:

  • Our total liability arising out of or in connection with any project is limited to the amount actually paid by you to us for that project.
  • We are not liable for indirect, incidental, special or consequential losses, including loss of profit, loss of use, loss of data or business interruption.
  • We are not liable for damage to items that were not moved or secured by you before we started work, or for damage caused by pre-existing defects in the property.
  • Nothing in these Terms limits any liability that cannot lawfully be limited, including under the Consumer Protection Act, 2008.

10. Cancellation and rescheduling

  • You may cancel or reschedule a booking by giving us reasonable notice, ideally at least 48 hours before the scheduled start.
  • Late cancellation or repeated rescheduling may attract a reasonable charge to cover materials already procured and time already committed.
  • We may reschedule work where weather, safety, illness or supplier delays make it unsafe or impractical to proceed, and will give you as much notice as reasonably possible.

11. Health, safety and site conditions

We follow reasonable health and safety practices on site. Please tell us in advance about any special risks (for example swimming pools, unstable structures, dogs, alarm systems or vulnerable occupants) so we can plan accordingly.

12. Intellectual property

All content on the Site, including text, logos, images and graphics, is owned by or licensed to Devine Painting and is protected by South African and international copyright and trademark laws. You may not copy, reproduce, republish or use our content for commercial purposes without our written permission.

We may photograph completed work and use those photographs for our portfolio, website and marketing, without identifying you or your address, unless you ask us in writing not to.

13. Third-party sites and services

The Site may link to third-party websites (for example WhatsApp or Google). We are not responsible for the content, security or privacy practices of those third-party sites and services.

14. Privacy

Our use of your personal information is governed by our Privacy Policy, which forms part of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. The parties will attempt in good faith to resolve any dispute directly before referring it to mediation or to the courts of South Africa, which will have exclusive jurisdiction.

16. Severability and updates

If any part of these Terms is found to be unenforceable, the rest will remain in force. We may update these Terms from time to time. The version published on the Site at the time you engage us applies to that work.
